By accessing or using the website at www.mandaninsulation.com (the "Site"), or by requesting or receiving services from Mandan Insulation, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or our services.
These Terms and Conditions apply to all visitors, users, and customers of Mandan Insulation ("we," "us," or "our"). We reserve the right to update these terms at any time by posting a revised version on this page with an updated effective date.
Mandan Insulation is a licensed insulation contractor based in Mandan, ND. We provide residential and commercial insulation services including, but not limited to, spray foam insulation, attic insulation, blown-in insulation, crawl space insulation, basement insulation, wall insulation, air sealing, vapor barrier installation, and insulation removal.
Services are performed in the Mandan area and surrounding communities in central and western North Dakota. We reserve the right to decline any project at our discretion.
All estimates provided by Mandan Insulation are based on the information available at the time of the site visit and assessment. A written estimate is provided before any work begins.
Estimates are valid for 30 days from the date of issue unless otherwise noted. Changes in project scope, materials, or site conditions discovered after work has begun may result in a revised estimate. We will notify you of any scope changes before proceeding with additional work.
Prices listed in any estimate include labor and materials unless specifically stated otherwise. Sales tax, permit fees, and other charges imposed by governing authorities are not included unless itemized in the estimate.
Appointment dates and times are confirmed in writing or verbally at the time of scheduling. We ask that you notify us at least 48 hours in advance if you need to reschedule or cancel.
Late cancellations (fewer than 24 hours notice) or no-shows may result in a trip charge to cover our costs of dispatching a crew. The amount, if any, will be communicated to you before it is applied.
We reserve the right to reschedule appointments due to weather conditions, equipment issues, or other circumstances beyond our control. We will notify you as early as possible if rescheduling is necessary.
Payment is due upon completion of the work unless a payment schedule has been agreed to in writing prior to the start of the project. Accepted payment methods will be communicated to you in advance.
For larger projects, we may require a deposit before scheduling installation. The deposit amount and terms will be stated in your written estimate.
Accounts not paid within 30 days of the invoice date may be subject to a late payment fee. We reserve the right to pursue collection through appropriate legal channels if payment is not received.
You are responsible for ensuring that the work area is accessible on the scheduled installation date. This includes clearing access to attic hatches, crawl spaces, basements, and any other areas where work will be performed.
For spray foam insulation projects, you and all occupants - including pets - must vacate the premises during installation and for the re-entry period specified by your contractor. Failure to do so may result in rescheduling and a trip charge.
You agree to provide accurate information about the property when requesting an estimate. Inaccurate information that affects the scope or cost of work may require a revised estimate before work continues.
Mandan Insulation warrants that all work will be performed in a professional and workmanlike manner, using materials appropriate for the application. Any warranty on labor or workmanship, if offered, will be stated in writing at the time of the project.
Material warranties, if any, are provided by the manufacturer and are subject to the manufacturer's terms and conditions. We do not extend or modify manufacturer warranties.
Warranties do not cover damage caused by conditions outside our control, including but not limited to moisture intrusion from roof leaks or plumbing failures, structural movement, pest infestation, or modifications to the work by any party other than Mandan Insulation.
The Site and all content on it are provided "as is" without any warranty of any kind, expressed or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
To the maximum extent permitted by applicable law, Mandan Insulation will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our website or the services we provide.
Our total liability for any claim arising from services rendered will not exceed the amount you paid us for the specific project giving rise to the claim. This limitation applies regardless of the theory of liability.
All content on the Site - including text, images, logos, and page layout - is the property of Mandan Insulation or its content suppliers and is protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content on this Site without our prior written permission.
If a dispute arises between you and Mandan Insulation relating to these Terms or our services, we encourage you to contact us first at info@mandaninsulation.com so we can work to resolve it informally.
If informal resolution is not possible, the parties agree to attempt mediation before pursuing litigation. Any legal action not resolved through mediation will be brought exclusively in a court of competent jurisdiction in Morton County, North Dakota.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of North Dakota, without regard to its conflict of law provisions. By using this Site or engaging our services, you consent to the exclusive jurisdiction of the courts located in North Dakota.
We reserve the right to modify these Terms and Conditions at any time. Changes take effect immediately upon posting to the Site with an updated effective date. Your continued use of the Site or our services after any changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
